Removal Guarantee Terms & Conditions

1. Acceptance of Terms
By submitting your information via our online form and checking the agreement box, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. These terms govern your participation in our free furniture pickup service and the associated $200 guarantee.

2. Service Overview

  • Submission: You provide your name and contact details via our online form.
  • Information Request: We will contact you via text and request additional information and photos.
  • Approval: Your eligibility for free pickup is determined by the Company in its reasonable discretion based on the information provided, including any details requested during the approval process.
  • Scheduling: If approved, you will be prompted to schedule a pickup day.

3. $200 Guarantee

  • Guarantee Provision: If the Company fails to effect pickup of your approved items by the end of your scheduled day—due solely to a Company error such as overbooking or scheduling mistakes—and you have provided all information requested, we will pay you $200.

4. Customer Representations and Responsibilities

  • You represent that all information, including photos and details provided in response to our requests, is accurate and complete.
  • If any item promised for removal is sold, disposed of, or otherwise rendered unavailable before the scheduled appointment such that the overall value or volume of items is materially reduced, the Company reserves the right to cancel the appointment and void the guarantee.
  • If it is determined that you have willfully misrepresented or deliberately omitted material information, the $200 guarantee will be void, and you will incur an administrative fee of $100, representing a reasonable estimate of the costs incurred by the Company.
  • You are responsible for ensuring that the items are safely accessible for removal. If items are blocked, unsafe, or otherwise inaccessible, the guarantee will not apply.

5. Inspection and Pickup Conditions

  • Final Inspection: Upon arrival, our team will inspect the items. Should they find any discrepancies or issues not disclosed during the approval process, we reserve the right to refuse pickup.
  • Safety and Accessibility: Items must be readily accessible and safe to remove. Failure to meet these conditions voids the guarantee.

6. Limitation of Liability
Our liability under this Agreement is limited to the $200 guarantee per approved pickup. In no event shall we be liable for indirect, incidental, or consequential damages. This limitation shall not apply in cases of gross negligence or willful misconduct.

7. Dispute Resolution
Any dispute arising from these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (or another mutually agreed upon arbitration service) in accordance with its rules. The arbitration shall be conducted in Denver, CO unless otherwise mutually agreed. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.

8. Amendments and Notice
The Company reserves the right to amend these Terms at any time. Material amendments will be posted on our website. Your continued use of our service after such posting constitutes acceptance of the updated Terms.

9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles.

10. Entire Agreement
These Terms, together with any documents expressly incorporated herein, constitute the entire agreement between you and the Company regarding the subject matter herein.
